These General Terms and Conditions of Sale govern the offer and sale of products on our web site ("GASBIJOUX.COM").
The products purchased on GASBIJOUX.COM are directly sold by GAS BIJOUX. GAS BIJOUX is registered with the Companies' Register of Paris under no. 440 266 765 00013, Tax Code and VAT no. FR 01 440 266 765. GAS BIJOUX’s registered office is located in France – 4 rue Clémence 13006 Marseille.

Our Business Policy

GAS BIJOUX offers products for sale on GASBIJOUX.COM and its e-commerce business services are available exclusively to its end users, i.e. the ""Consumers"".

""Consumer"" shall mean any individual who is acting for purposes which are outside of his or her trade, business or profession. If you are not a Consumer, please do not buy any products on GASBIJOUX.COM.

GAS BIJOUX reserves the right not to process orders received from users who are not ""Consumers"" and any other order which does not comply with GAS BIJOUX's business policy.

These General Terms and Conditions of Sale exclusively regulate the offer, transmission and acceptance of purchase orders relating to products on GASBIJOUX.COM between the users of GASBIJOUX.COM and GAS BIJOUX.

The General Terms and Conditions of Sale do not regulate the supply of services nor the sale of products performed by third parties which are on GASBIJOUX.COM through links, banners or other hypertext links. Before sending orders and purchasing products and services from those third parties, we recommend that you verify third party terms and conditions on the web site from which you may be considering purchasing a product, since GAS BIJOUX shall in no circumstances be deemed liable for the supply of services provided by third parties nor for the execution of e-commerce transactions between the users of GASBIJOUX.COM and third parties.

How to Execute a Contract with GAS BIJOUX

Placing an order online is easy. Using our search options, you can find whatever you are looking for. Click on the images to be taken to the category pages, then product pages in order to look at each product in detail. Articles can be added to your basket after you have selected the size and quantity of the garments. Make sure you check the size, colour and quantity of products that you place in your basket. To delete an article, click on delete. You can then choose to place your order or to continue shopping. You can also choose to place your order by phone. If you would like to place your order by phone our customer service department will be happy to assist you. You can contact our customer service department at +33 1 40 26 41 07. In order to finish the buying contract of one or multiple products on the site you must fill in the order form which is provided on the site by following the relative instructions.

The order form contains a summary of these General Terms and Conditions of Sale, information on the main characteristics of each product ordered and the relevant unit price (including all applicable fees and taxes), the type of payment that you may use in order to purchase each product, shipping terms for the purchased products, shipping and delivery costs and the terms and conditions for the return of purchased products.

An order shall be deemed to have been submitted upon the electronic receipt of your order form by GAS BIJOUX.

Before submitting your order form for the purchase of products, you will be asked to carefully read the General Terms and Conditions of Sale, to print a copy through the print option and to save or reproduce a copy thereof for your own personal use.

The order form will be filed in our data base for the period of time required in order to process your order, and as provided by law. You may access your order form, free of charge and at any time, by clicking on the section called Order Status.

Before submitting the order form, you will be asked to identify and correct possible in-put errors.

The submission of orders to GAS BIJOUX must be carried out in French or English.

After your order form has been submitted, GAS BIJOUX will process your order.

GAS BIJOUX may not process purchases that do not give sufficient guarantees of solvency or which are incomplete or incorrect, or orders for products that are no longer available. In the above cases, we shall inform you by e-mail that the contract has not been executed and that GAS BIJOUX has not carried out your purchase order specifying the reasons thereof. If the products displayed on GASBIJOUX.COM are no longer available at the time of your last access and once GAS BIJOUX has received your order form, GAS BIJOUX shall inform you within thirty (30) working days of receipt of your order of the unavailability of the ordered products. If the order form has been sent and the price has been paid for items that are no longer available, GAS BIJOUX will refund you the sum paid.

By submitting an order form and contracting with GAS BIJOUX, you unconditionally accept and undertake to observe the provisions of these General Terms and Conditions of Sale. Should you not agree with certain provisions of these General Terms and Conditions of Sale, please do not submit your order form for the purchase of products on GASBIJOUX.COM. By submitting an order form, you agree and accept these General Terms and Conditions of Sale as well as the further conditions contained on GASBIJOUX.COM, also through links, including the General Terms and Conditions of Use and the Privacy Policy.

Upon submission of an order form, GAS BIJOUX shall send you, via e-mail, a receipt of the purchase order, containing a summary of the information related to the order form (General Terms and Conditions of Sale, the products' main characteristics, a detailed indication of the price, terms of payment, return right and shipping costs).

Warranties and Indication of Product Prices

On GASBIJOUX.COM, we offer for sale luxury and top-quality products. These products are purchased by GAS BIJOUX directly from fashion houses, manufacturers and dealers, carefully selected by stringent quality controls.

GAS BIJOUX does not sell second-hand products, flawed products or products of lower quality as compared to the corresponding standards offered on the market. Only vintage products, which are sold in a specific area on GASBIJOUX.COM, may be second hand and/or in a worn condition because of the particular nature of the product. In the description of each vintage product, GAS BIJOUX will specify the preservation conditions of the products if different from the standards set by the market.

The main characteristics of the products are shown on GASBIJOUX.COM inside each product schedule. The products offered for sale on GASBIJOUX.COM may not exactly correspond to the real garments in terms of image and colours because of the Internet browser or of the monitor used.

Prices are subject to change. Check the final price of sale before sending the relevant order form.

All Products come with a label attached. Do not remove the label or relevant seal from the purchased products should you wish to return the purchased product.

Should you decide to exercise your right to return purchased products, GAS BIJOUX will not accept returned products that are returned without the relevant label or seal or that have been altered from their original status or damaged.

Payments

Payment of the products and relevant shipping costs must be made by using one of the procedures indicated on the order form.

In case of payment by credit/debit card, all details (for example, card number or expiration date) will be sent by encrypted protocol to PAYBOX or other banks which provide remote electronic payment services, without third parties having any access thereto whatsoever. Such details will not be used by GAS BIJOUX except for performing the procedure relevant to your purchase or issuing relevant refunds in the case of returns, in compliance with the exercise of your return right or for reporting cases of frauds to the police.

The price for the purchase of products and the relevant shipping costs, as indicated in the order form, will be charged to your current account at the moment they are ordered.

Shipping and Delivery of the Products

The information provided in these sections form an integral part of these General Terms and Conditions of Sale and, consequently, shall be deemed to be fully known and accepted by you at the time your order form is sent.

Returns

You may return products purchased from GAS BIJOUX, without any penalty and without specifying the reason within seven (7) working days of receipt of the products purchased on GASBIJOUX.COM.

To cancel your contract with GASBIJOUX.COM, you will need to send an e-mail to return@gasbijoux.com, with the invoice number, description of the products you wish to return and optionally the reason for this return. We will send you a Return Agreement Number (RAN) which you can then write onto your pre-filled return form and on the pre-printed UPS (our carrier) sticker, both included with your order.

In this case, you shall return the items to GAS BIJOUX within seven (7) working days. This period begins the day the items are delivered to you.

The only costs you will bear are the shipping costs of the return..

The return right - besides compliance with the terms and procedures described above - shall be deemed correctly exercised once the following conditions have been fully met:

You must send us an e-mail to request a RAN (Return agreement number)

The products must not have been used, worn, washed nor damaged

The labels must still be attached to the products

The products must be returned in their original packaging (in the case of audio CDs or books, they must be sealed as when sent. If you wish to return a kit or set, it must contain all the original components)

The returned products must be sent to GAS BIJOUX in a single delivery. GAS BIJOUX reserves the right not to accept products belonging to a single order returned and delivered at different times

Return items must be shipped back to GAS BIJOUX within seven (7) working days from the date the package was delivered to you.

If the return right is exercised in conformity with the provisions set forth in paragraph 5, GAS BIJOUX shall refund the sums paid for the returned products, excluding any of the original shipping costs (e.g. the delivery of the items to you)

GAS BIJOUX shall refund the sums already paid for the purchase of the products and the shipping costs for the delivery of the purchased products to you only if the products are returned for reasons that may be due to GAS BIJOUX, as in the case where the products do not have the promised essential characteristics, have manufacturing defects or that they have been erroneously delivered. In this last case you may use the return form.

GAS BIJOUX shall refund sums already paid as soon as possible and in any case within thirty (30) days from the date on which GAS BIJOUX has become aware of your decision to exercise your return right. We will promptly start the procedure for refunding the sums, after having confirmed that the terms and conditions stated above have been duly complied with, as indicated in paragraph 7.

In the event that your return does not comply with the terms and conditions set out in paragraph 5 of these General Terms and Conditions of Sale, you will not be entitled to any refund of the sums already paid to GAS BIJOUX nevertheless, you shall be entitled, at your own expense, to receive the products in the conditions in which they were sent back to GAS BIJOUX. If you do not wish to receive the products in the conditions in which they were sent back to GAS BIJOUX, GAS BIJOUX shall be entitled to keep the products and withhold the sums already received.

Refund Times and Procedures

After the products have been returned, GAS BIJOUX shall check the conformity of the products with the conditions indicated above. When GAS BIJOUX is able to confirm that such conditions have been met, GAS BIJOUX shall send you the relevant confirmation of acceptance of the returned products by e-mail.

The refund will be made in the same way that the product was originally purchased. The refund procedure shall be started by GAS BIJOUX within thirty (30) days starting when GAS BIJOUX is informed of your decision to return the goods, after checking that the return right has been correctly exercised and that the returned products are accepted.

If the recipient of the products, as placed in the order form, is different from the individual who made the payment for such products, the sums paid shall be refunded by GAS BIJOUX to the individual who made the payment.

The currency exchange rate for the credit shall be the same as the currency exchange rate of the original debit and consequently you shall not lose out in terms of bank interest.

GAS BIJOUX has chosen UPS (which can be contacted at UPS numbers) as GAS BIJOUX’s official package delivery company for returning products purchased on GASBIJOUX.COM. You may return products to GAS BIJOUX through UPS International by using the pre-printed label enclosed in the package in which the products have been delivered. This enables GAS BIJOUX to pay for the shipping costs and to track the package at any time.

If you decide to return products using a different shipping company other than the one indicated by GAS BIJOUX, shipping costs will be charged to you, and you will be responsible for any loss or damage to the products (howsoever caused).
